Real-Life scenario:

Mr and Mrs Brown from Weston-s-Mare are in their 50's and this is a second marriage for both of them. They have two children each from their previous relationship, all of whom are now independent. Mrs Brown has put more money in to the purchase of their home which is owned jointly.

They would like their respective children to inherit 'what is theirs', and also ensure they do not affect each other's standard of living regardless of who dies first.

This was an especially long and emotional consultation requiring careful handling around a number of subjects. We had two cups of tea! Once everything was out in the open I was able to explain an alternative structure for owning their home - Tenants-in-Common which can be 50/50 ownership in their own names, but also allows for unequal shares. We calculated and agreed a 60/40 split with Mrs Brown owning the greater share.

 

With the tenancy 'severed' their Wills each contained a Trust for their share of the property to be held for their two children should they be the first to die. In addition the surviving partner was provided with the right to continue living in the house for the rest of their lifetime unless they remarried (this would trigger the need for the house to be sold and the deceased children to inherit their share).​​​
